A youth client was found in possession of a knife and therefore charged with possession of an offensive weapon, namely a folding knife.
The Defence had concerns that the charge was not made out, particularly given inconsistencies between the photographs and the officers’ explanations on how the knife was described. To address those concerns, the Defence instructed an independent weapons expert to examine the exhibit. The expert confirmed that the knife was readily foldable and had a blade length of under three inches thus no offence had been committed. That expert report was then served on the Crown, together with Defence representations which resulted in the Prosecution discontinuing the case, allowing this young client to maintain his good character.
