R v J Conspiracy to Supply Drugs at Portsmouth Crown Court – 2024
Andy was instructed to represent his client alleged to have played a leading role in the large scale supply of class A,B,C and prescription drugs which were sent out via the postal system to customers across the country.
The client entered a not guilty plea to the class A offences and guilty pleas to the remaining counts. A basis of plea was submitted limiting the client’s role within the conspiracy which was not accepted by the Prosecution who maintained the client held a leading role.
A Newton hearing took place over 2 days where evidence was called, and witnesses were cross examined. The defence were successful at the Newton hearing and The Judge found that the Prosecution case against the client was not proven, and the client therefore fell to be sentenced on the basis of plea as originally submitted by the defence.
As a result, the client was sentenced to a suspended sentence of 18 months imprisonment suspended for 2 years.
