R v DD Perverting the Course of Justice at Lewes Crown Court – 2022
Andy’s client faced 3 counts of perverting the Course of Justice. This was a fascinating, complex and protracted case, that had previously received much Media attention.
The history to the case was that in 2014, a former firearm was convicted of raping our client as a child in the 1970s. In 2014 the male was convicted of the offences and sentenced to 8 ½ years in custody.
Having served over 3 years of his prison sentence, his conviction was then quashed on appeal after fresh evidence casting doubt upon the original conviction was provided to the Court of Appeal.
Andy’s client DD was then prosecuted for making, what were said to be untrue claims to Police in a witness statement leading to the original conviction and also untrue claims in a statement of truth made in support of a civil claim he had subsequently taken out against the man in question.
Following legal argument and negotiations with the prosecution, despite the seriousness of the case, we were able to whittle the Indictment down to a single count and Andy’s client would later enter a guilty plea to a single count on the indictment and received a suspended sentence only.
