Fraud, Consumer Protection Offences and Misleading Practices – No Further Action – No Charges brought – 2023

Andy’s client was a small business owner whom, was investigated by Trading Standards in relation to allegations of an alleged fraud.

Having taken detailed and comprehensive instructions Andy was able to obtain evidence in support of our client’s case including evidence that a rogue web designer was responsible for errors to the design of the website and that the website company used to design the site had previously dismissed this employee and that those errors had subsequently been rectified.

Evidence was also obtained and deployed in terms of the cancelation rights, necessity and the overall cost of the building work via documentation, emails and photographic evidence.

Andy then able to make strong lengthy written representations to Trading Standards together with the provision of evidence, that resulted in investigators withdrawing their request for the client to attend an interview to be questioned under caution.  The investigation was then closed, and no further action taken.

Again, in this case – an early positive resolution was obtained by pro-actively building the defence case and engaging with investigators at an early point in the investigation.
